Terms and Conditions

We are the “Qrocery” (Business Name Registration Number BN10952020), an establishment under FALIM Group Private Limited (C-0007/2001). The terms “we”, “us” and “our” throughout this website refers collectively to the Qrocery and FALIM Group Private Limited and “our website”, “our site”, “our app” and “services” or “our services” refers to “”.

When you shop with us (or access our services, our website or our app), these terms and conditions, including those additional terms and conditions or policies referenced herein apply and constitute your acceptance of these terms, conditions and policies. They are important for both of us as they set out what we expect from each other, and they also give you helpful information.

We keep these terms updated and we amend them every so often, so remember to check back in before you shop, as the latest set will apply.

About you
To shop with us from our site, you need to:
(a) be at least 18 years old;
(b) have a Bank of Maldives MVR or USD account with Internet Banking enabled (if you are paying payment via bank transfer); or
(c) have a credit or debit card that we accept (applicable only when online card payments are accepted for payment on our website) and be authorised to use that card if it is not in your name.

For your information, some of the goods sold through our website may not be permitted to be sold to under 18s.

Your information
Our site will store personal information you provide at the time of creating your account or at the checkout. Our Privacy Policy sets out how we will use your information. If your details change, remember that you need to update ‘My Account’ so we can continue giving you our best service.

Placing an order
When you place an order, you should receive an acknowledgement e-mail confirming receipt of your order. We then proceed to verify your order and ensure we have all goods you have ordered in stock.

If we have not already received your payment into our account specified at the checkout via bank transfer, we will then contact you via Viber/WhatsApp on the mobile phone number provided to confirm receipt of your order and request to complete the payment and send the transfer slip via Viber/WhatsApp to us.

We only accept your order once payment has been made and in the case where payment is made by debit or credit card at the time of checkout, when we have verified receipt of payment (and then the contract is made based on these terms).

Once you have placed an order, you can change or cancel the order only by contacting us. Cancellation of an order is not allowed if payment is already made provided that we are able to fulfil your order. Changes to your order are permitted as long as the value of the order remains the same or you are willing to pay for the additional amount due to changes. For more details about changes and cancellation of your order please refer to our Returns and Refunds Policy.

All orders are subject to availability and confirmation of the ordered price. If there is an issue with an order, we will get in touch with you.

Very occasionally, we may need to refuse or cancel an order or close or freeze an account (even if we have previously confirmed your order) – e.g. if we notice something unusual on an order or an account. If this happens to you and you think we have made a mistake, please get in touch with us and we will be happy to speak to you about it.

Prices, product and other information
We put in a lot of effort to ensure the information on our website is up to date and accurate. Sometimes due to mistakes or technical errors product photos, product description, price or availability may be incorrectly updated or omitted on our website. We may also not have product photos for new products available on the website immediately.

After you have placed an order, if we discover an error for any goods you have ordered, including errors in how the good have been priced, or if any ordered goods are currently out of stock, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price, replacing substitutes for out of stock products or cancelling it.

If you do not wish to substitute a new product for an out of stock product or would like to cancel the order in full, and if payment is already made we will proceed to refund you in accordance with our Refunds and Refunds Policy.

If we cannot get in touch with you, we will put your order on hold until we are able to get it touch with you.

Prices include GST (where applicable).

Prices for our products are subject to change without notice. We may also at any time modify or discontinue a product we offer (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of any products or services.

We only deliver to Male’ and Hulhumale at present. Alternatively you may also chose to place order from our website to opt to pick up your order from Qrocery store at H. Feyrugasdhoshuge, Ameeru Ahmed Magu, Male’, Maldives during our opening hours. If you opt to pick up your order, please specify at the checkout.

You orders will be delivered between 12pm to 10.30pm daily in the order in which we receive your payment confirmation. For more information please also refer to our Delivery Policy.

Use of user generated contents
We welcome your feedback and comments to improve our services or otherwise. By sending us comments and feedback via any medium, you agree that we may, at any time, without restriction, copy, publish, distribute or otherwise use in any medium any comments and feedback that you forward to us.

You also agree that your feedback and comments will not violate any copyright, trademark, privacy, personality or other personal or proprietary rights. You further agree that your comments will not contain defamatory or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect our operation of the website and services. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

Prohibited uses
You must not misuse or tamper with our websites, apps or other services (e.g. hack, introduce viruses, trojans, worms, logic bombs or other technologically harmful material or carry out denial of service attacks etc) or otherwise mess with our technology or functionality or steal our or our customers’ data. Doing any of these things may be a criminal offence, but they also get in the way of us giving our loyal customers the best service, so we take them really seriously. We will report any such breach or activity (and all information about the people carrying it out) to the relevant law enforcement authorities.

We recommend you use virus protection software when using any website, including ours. Although we have implemented measures to stop people messing with our website, we cannot guarantee that it will always be secure from bugs, viruses or trouble-makers.

You also agree to indemnify, defend and hold harmless Qrocery and our parent company FALIM Group and its directors, officers, employees, consultants, agents, and affiliates, from any and all third-party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use (or misuse) of this website or your breach of the Terms and Conditions.

We reserve the right to refuse service to anyone for any reason at any time.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

We have the right to amend, remove or vary our services and/or any part of the website (including our Terms and Conditions and Policies at any time.

These terms and our dealings with you are subject to Maldivian law and the exclusive jurisdiction of the Maldivian courts.

The failure of us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.

These Terms and Conditions and Policies posted by us on this site or in respect to our service constitutes the entire agreement and understanding between you and us and govern your use of the Service. The most recent version of these Terms and Conditions will supersede any prior agreements, oral or written, between you and us.

The products offered on our website are provided as is without any guarantees or warranty. In association with the products, Qrocery or its parent company FALIM Group Private Limited makes no warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, of title, or of non-infringement of third party rights. Use of the product by a user is at the user’s risk.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
